Inclusive or on top
On top means the fee is the fee and super is paid in addition. A $400 fee costs you $448 in total, and the player receives $400.
Inclusive means the agreed amount already contains the super. $400 inclusive is $357.14 to the player and $42.86 to their fund. The amount is divided by 1.12, not reduced by 12%, which is why it is not $352.
Both are legal. The two of you agree which, and it should be in writing before the gig. Whichever you choose, the super has to go to the fund. You cannot hand it to the player instead.
Only the work attracts super
Super applies to the part of the payment that is for the person's work. If an invoice itemises studio hire, equipment hire, freight, travel, accommodation, other people the player engaged, use of intellectual property, or use of their own gear, those parts are left out.
So enter the performance fee here, not the invoice total. If a player sends you one lump sum with no breakdown, the whole amount counts as work, so ask them to itemise it.
GST is never part of the super base. Super is worked out on the fee with GST excluded.
The due date
The contribution has to be received by the fund within 7 business days of the day you pay the fee, and within 20 business days if it is the first contribution you have made for that player. Business days exclude weekends and public holidays counted nationally: a holiday observed across any state stops the clock for everyone.
This works out one player at a time. Sidefill does a whole gig, writes the invoices, and keeps the record.
